RELEASE, WAIVER, INDEMNIFICATION, HOLD HARMLESS, AND ASSUMPTION OF RISK AGREEMENT
Whereas, in return for the use of premises, instruction in the use of firearms and safety, modest club dues and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Undersigned agrees to the following:
The Undersigned agrees to release, hold harmless, indemnify and defend The Spokane Rifle Club, Inc., and any of its employees, directors, officers, agents and volunteers (hereinafter “SRC”) from any and all fault, liabilities, lawsuit costs, expenses, claims, or demands arising out of, or related to, or connected with the Undersigned’s participation in a course of instruction, the use of any and all club property and facilities (hereinafter the “Premises”), the discharge of firearms and the Undersigned’s presence on or use of said premises and any and all acts or omissions of the Undersigned, the Undersigned’s children or the Undersigned’s grandchildren. And should any such claim, demand or lawsuit arise or be asserted in any way whatsoever related thereto, whether arising under the laws of the United States or of any State, or under any theory of law or equity , the Undersigned will indemnify, hold harmless and defend the SRC from any and all costs, expenses or liability including, but not limited to, the cost of any judgment rendered against the SRC, whether individually, jointly, or in solido with the Undersigned, together with all costs of court and other costs or expenses incurred in connection with any such claim, demand or lawsuit, including attorney’s fees.
The Undersigned furthermore waives for himself/herself and his/her executors, administrators, assignees or heirs any and all rights and claims for damages, losses, demands and any other actions whatsoever, which he/she may have or which may arise against the SRC, (including, but not limited to any and all injuries, damages or illnesses suffered by the Undersigned or the Undersigned’s property), which may, in any way whatsoever, arise out of, be related to or be connected with: a course of instruction, the Premises, including any latent defect in the Premises, the Undersigned’s presence on or use of said Premises, the Undersigned’s property (whether or not entrusted to the SRC), and the discharge of firearms. The SRC shall not be liable for, and the Undersigned, on behalf of himself/herself and his/her executors, administrators, assignees or heirs, hereby expressly releases the SRC from any and all such claims. The Undersigned furthermore expressly assumes the risk of entering the Premises and of taking part in activities on the Premises which include, but are not limited to, the discharge of firearms, the firing of live ammunition, and instruction in the use of firearms.
On behalf of my minor child or children, my unborn children, and my minor grandchildren I agree to the release of liability, indemnity, hold harmless, and assumption of risk provisions contained in this agreement and I further agree to defend, indemnify and hold harmless the SRC to the fullest extent permitted by law from any claim for injury or loss incurred now or in the future, brought by any minor child or grandchild of mine against the SRC. I also promise to pay any financial obligation my minor child or grandchild owes the SRC and does not pay.
I understand and acknowledge that the SRC does not manufacture much of the equipment at its facilities, but purchases and/or leases equipment. I understand and acknowledge that the SRC is providing recreational services and shall not be held liable for defective products. I agree fully and without reservation to all the release, hold harmless, assumption of risk and indemnity provisions of this agreement as they pertain to the SRC. This does not include claims for defectively manufactured products or sellers of defectively manufactured products other than the SRC.
The Undersigned expressly agrees that this instrument is intended to be as broad and inclusive as permitted by law, and that if any provision of this instrument is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby.
The Undersigned furthermore hereby certifies he/she is over 18 years of age, has the right to own and possess firearms in Washington State and the Unites States of America, would be approved for the purchase of a firearm by a FBI instant background check, and has never been convicted of a crime of violence.
The Undersigned furthermore acknowledges and agrees that he/she has read, understands, and will at all times abide by all the SRC range rules and procedures, all instructions of the Range Safety Officers, and help enforce the same while on the club property.
This instrument binds the Undersigned and his/her executors, administrators, assigns or heirs. By signing, I acknowledge and agree to the above terms and conditions.
